By accessing or using Flash Chat, you agree to be bound by these terms. If you do not agree with any part of these terms, please do not use our Platform.
1. Platform Overview
Flash Chat is a WhatsApp marketing platform that facilitates:
Bulk Messaging
Send WhatsApp messages to multiple contacts with approval of WhatsApp templates.
- Template-based messaging

- Scheduled campaigns
Automation
Automate responses and workflows for efficient communication.
- Quick replies
- Chatbots
- Drip campaigns
Flash Chat operates in compliance with WhatsApp's policies - users must adhere to all WhatsApp Business API terms.
2. User Responsibilities
All users must adhere to these fundamental responsibilities:
Account Security
Maintain confidentiality of your account credentials:
- Use strong passwords
- Enable two-factor authentication
- Notify us of unauthorized access
Compliance
Adhere to all applicable laws and regulations:
- WhatsApp Business Policy
- TCPA (Telephone Consumer Protection Act)
- GDPR (if applicable)
Contact Management
Proper handling of contact lists:
- Only message opted-in contacts
- Maintain proper consent records
- Honor opt-out requests immediately
Prohibited Activities
Users must not engage in:
- Spamming or unsolicited messages
- Misrepresentation
- Illegal or harmful content
3. Account Requirements

Subscription Plans

- No auto-renewal - manual renewal required

- Require approval from WhatsApp
- 24-hour review period for new templates
24-Hour Window
WhatsApp messaging rules:
- Template messages for new conversations
- Free-form messages within 24-hour window
- Session messaging rules apply
4. Payments & Pricing
Financial terms and payment processing details:
Subscription Fees
For platform access:
- Monthly/Annual payment options
- GST applicable as per Indian law
- Price changes with 30-day notice
Message Credits
For sending messages:
- Pre-purchase message credits
- Non-refundable
- Expire after 12 months
Refund Policy
Conditions for refunds:
- All payments are final and non-refundable
- Ensure service requirements before making payment
- Support available for issue resolution
WhatsApp Fees
Important notes:
- WhatsApp charges separate conversation fees
- Not included in Flash Chat subscription
- Billed directly by WhatsApp
5. Dispute Resolution

- Flash Chat is not responsible for content
- Users must resolve directly with recipients
- We may mediate if both parties agree
Legal Jurisdiction

- Disputes resolved in Dausa (Rajasthan) courts
- Arbitration preferred
Suspension/Termination
When we may suspend accounts:

6. Limitation of Liability

Message Delivery
We don't guarantee delivery of WhatsApp messages as it depends on WhatsApp's infrastructure.
Content Responsibility
Not responsible for message content or outcomes from sent messages.
API Changes
Not liable for changes to WhatsApp API that affect functionality.
Maximum Liability
Our maximum liability is limited to the subscription fee paid.
7. Changes to Terms
Update Notification Process
We may update this Terms periodically to reflect changes in our practices or legal requirements. Significant changes will be:

Posted on our Platform with a "last updated" date
Email Notifications
Registered Users will be notified via email
Dashboard Alerts
Displayed in User Dashboard for 30 days
Continued use after changes constitutes acceptance of new terms.
